1. Introduction and purpose

These General Terms of Use (hereinafter: "Terms") govern the legal relationship between ARSIO SYSTEMS d.o.o. (hereinafter: "Provider") and every user of the Karierni Asistent web platform, accessible at www.karierni-asistent.si and app.karierni-asistent.si (hereinafter: "Platform").

Karierni Asistent is a combined employment platform and SaaS recruitment tool that brings together:

  • a portal for publishing job listings and finding employment,
  • a database of CVs and job seeker profiles,
  • tools for automated recruitment campaigns on social networks,
  • a messaging system between employers and job seekers,
  • paid advanced services for employers and recruitment agencies.

By accessing the Platform, registering, or using the Services in any way, you declare that you have read these Terms, understand them, and fully agree to them. If you do not agree to the Terms, you must not use the Platform.

2. Definitions

Platform
The website www.karierni-asistent.si, the web application app.karierni-asistent.si, and all their subpages, mobile applications, and related services.
Provider
ARSIO SYSTEMS, development of digital solutions and other services, d.o.o., Ulica škofa Maksimilijana Držečnika 6, 2000 Maribor, Slovenia, registration number 7342578000.
User
Any natural or legal person who accesses the Platform or uses its Services, regardless of the method of access (registered or unregistered).
Job Seeker
A registered User – a natural person who uses the Platform for the purpose of finding employment, creating a professional profile, or applying for job listings.

Agency
An Employer acting on the Platform on behalf of and for the account of third parties (clients) in the search for personnel, for which it must have an appropriate legal basis. The rights and obligations of Agencies are equated with those of Employers, unless expressly stated otherwise.
Services
All functionalities and services available to Users on the Platform.
Subscription
A periodic payment for access to paid Platform Services.
Listing
A job listing published by an Employer on the Platform.
Content
All data, texts, images, CVs, profiles, and other materials entered or published by Users on the Platform.
Price List
The current list of Service prices published on the Platform.
GDPR
Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of individuals with regard to the processing of personal data.

3. Registration and user account

3.1 Registration

Basic use of publicly accessible Platform content is possible without registration. Access to all functionalities requires registration and the creation of a User account.

Registration involves entering basic details (name, surname, email address, password) and accepting these Terms and the Privacy Policy. Registration is completed upon confirmation via an activation link within 72 hours. Each User is entitled to one active account. A registered user must be at least 16 years old.

3.2 Account security

The User is responsible for safeguarding their login credentials and for all activities carried out using their login. Passwords are strictly personal and must not be shared with others. Any suspicion of misuse or unauthorized access must be reported immediately to info@karierni-asistent.si.

3.3 Accuracy of data

The User warrants that all data entered on the Platform is accurate, truthful, and up to date. Entering third-party data without their consent, impersonating another person, and providing fictitious data are prohibited. The Provider reserves the right to immediately terminate an account upon detection of a violation.

4. Description of services

4.1 Services for Job Seekers

The following services are available to Job Seekers free of charge:

  • browsing publicly accessible job listings,
  • creating and managing a professional profile and CV,
  • applying for job listings,
  • receiving notifications about new listings by email (with consent),
  • messaging with employers via the Platform's messaging system.

4.2 Services for Employers and Agencies

The following services are available to Employers and Agencies, some of which are paid:

  • publishing job listings (paid per Price List),
  • access to the CV and job seeker profile database,
  • tools for automated recruitment campaigns on social networks,
  • candidate application management system (filtering, commenting, archiving),
  • messaging with candidates via the Platform's messaging system,
  • advanced analytical tools (within paid packages),
  • priority support.

4.3 Duration of job listings

Job listings are active for a specified period in accordance with the chosen package. The minimum application period for candidates is three (3) working days, as required by Article 25 of the Employment Relationships Act (ZDR-1). Purchased listings must be published by the Employer within twelve (12) months of purchase, unless otherwise agreed in writing.

4.4 Recruitment campaigns on social networks

The Platform offers tools for preparing and publishing recruitment campaigns on social networks. The effectiveness of campaigns depends on many factors outside the Provider's control. The Provider does not guarantee the achievement of specific campaign results.

4.5 Messaging between users

The messaging system is intended exclusively for communication related to the recruitment process. It is prohibited to misuse the system for commercial purposes, to send spam, or for purposes unrelated to published listings.

5. Obligations and rights of job seekers

5.1 CV and profile

The Job Seeker undertakes to include only truthful and accurate data in their CV and profile, and to keep it regularly updated. Data that they do not wish to share must be omitted or hidden from the CV, and copies of personal documents must not be attached.

By activating their CV, the Job Seeker consents to its visibility to Employers on the Platform.

5.2 Privacy and anonymity

The Job Seeker determines the level of visibility of their data. When a profile is set to anonymous, the Employer can only see skills and work experience, not personal identification data. The Employer can contact them via an anonymous messaging form.

5.3 Prohibitions

  • misuse of Services for commercial purposes or sending content unrelated to job searching,
  • applying for job listings with a purpose other than job searching,
  • entering inaccurate, misleading, or false data,
  • infringing the rights of third parties or applicable law.

6. Obligations and rights of employers

6.1 Content of listings

The Employer is responsible for the content of published listings and undertakes that:

  • listings will be written in the Slovenian language and comply with the Public Use of the Slovenian Language Act (ZJRS),
  • content will not be discriminatory on the basis of gender, age, nationality, religion, disability, or any other protected characteristic,
  • listings will not advertise undeclared work,
  • statements will be accurate and will not mislead candidates,
  • listings will not infringe the intellectual property rights of third parties,
  • content will comply with the applicable Slovenian Advertising Code.

6.2 Protection of candidate personal data

The Employer undertakes to handle candidates' personal data in accordance with the GDPR and applicable Slovenian legislation, including Article 30 of the ZDR-1 (rights of the unselected candidate), Article 48 of the ZDR-1 (protection of employee personal data), and legally prescribed retention periods.

The Employer processes the personal data of Job Seekers as an independent data controller and bears sole responsibility for this processing.

6.3 Financial obligations

The Employer undertakes to settle invoices by the dates stated on the invoices. In the event of late payment, the Provider is entitled to charge statutory default interest and any collection costs. An order for a listing or service is binding.

7. Prices and payment

7.1 Price List

Platform services are free for Job Seekers, unless the Price List expressly states otherwise. Prices for Employer and Agency services are published in the current Price List. All prices are in euros (EUR). The Provider is not a VAT payer, so prices do not include VAT.

7.2 Payment models

  • Monthly or annual subscription: for access to a specific service package for the subscription period.
  • One-time payment per listing: for individual job listing publication without a subscription.

7.3 Payment methods

Payment is possible via the Stripe payment system (credit and debit cards, direct debit) or by bank transfer based on a received invoice (payment period: 15 days from issuance).

7.4 Subscription cancellation

The Employer may cancel the subscription at any time. Cancellation takes effect at the end of the current billing period. Payments for the current period are non-refundable.

7.5 Refund policy

Payments for already published listings or active campaigns are not subject to refund, except in cases where a Platform disruption originates exclusively from the Provider's side and the Employer has notified the Provider in writing within 7 days of the disruption.

8. User content and moderation

8.1 Prohibited content

It is prohibited to publish content on the Platform that violates applicable law, is discriminatory, offensive, hateful, or sexually explicit, contains false or harmful information, infringes intellectual property rights, constitutes terrorist content, endangers the safety of minors, or contains covert advertising.

8.2 Moderation

The Provider reserves the right to review and remove content. Any User can report illegal or inappropriate content via the "Report content" button or at info@karierni-asistent.si.

8.3 Sanctions

Upon a detected violation, the Provider may require a correction, remove content, temporarily disable or permanently terminate an account, and in serious cases, submit data to competent authorities.

8.4 Appeals procedure

A User may appeal a Provider decision within 6 months in writing to info@karierni-asistent.si.

9. Intellectual property

9.1 Provider's property

The Platform, including its source code, design, trademarks, logos, texts, and all other content created by the Provider, is copyright-protected property of the Provider. Copying, reproducing, decompiling, or automated data collection is prohibited without prior written consent.

9.2 User content

Content entered or published by a User on the Platform remains the property of the User. By publishing, the User grants the Provider a non-exclusive, royalty-free, temporally and territorially unlimited license to store, display, distribute, and technically process the content for the purpose of providing the Services. The license terminates upon deletion of the content or closure of the account.

10. Limitation of liability

The Platform and Services are provided "as is" and "as available". The Provider makes no express or implied warranties regarding the suitability of the Services, uninterrupted availability, accuracy of third-party content, or achievement of expected results.

The Provider's total liability to an individual User shall not exceed the amount paid by the User in the last twelve (12) months, or EUR 500, whichever is greater. This limitation does not apply to cases of intentional damage or gross negligence.

The User undertakes to indemnify the Provider against any claims, damages, costs, and legal fees arising from the User's violation of these Terms or the rights of third parties.

11. Personal data protection

The Provider processes Users' personal data in accordance with the GDPR, the Personal Data Protection Act (ZVOP-2), and the Privacy Policy, which forms an integral part of these Terms.

Employers who access Job Seekers' personal data via the Platform process such data as independent controllers in accordance with applicable law.

12. Platform availability and performance

The Provider endeavors to ensure Platform availability 365 days a year, 24 hours a day. The Provider reserves the right to brief interruptions for technical reasons without prior notice. In the case of planned maintenance exceeding 12 consecutive hours, it undertakes to notify Users at least three (3) days in advance.

The Provider is not responsible for unavailability resulting from force majeure, attacks on information systems, errors at third-party providers, or Users' own actions.

13. Geographic scope

Karierni Asistent is primarily intended for the market in the Republic of Slovenia and neighboring countries. Services are available to all Users regardless of their location, although the Provider does not guarantee compliance with the regulations of jurisdictions outside the European Union. Job listings must comply with the employment law of the country in which the work is to be performed.

14. Duration and termination of the contractual relationship

14.1 Duration

The contractual relationship is established upon registration and acceptance of these Terms and continues until the User or Provider terminates it.

14.2 Termination by the User

The User may close their account at any time without stating a reason via profile settings or a written request to info@karierni-asistent.si. After closure, personal data is deleted or anonymized in accordance with the Privacy Policy.

14.3 Termination by the Provider

The Provider reserves the right to immediately terminate an account without prior notice when a User violates these Terms, there is reasonable suspicion of fraud or a criminal offense, the User provides false data, or competent authorities so require.

15. Changes to the Terms

The Provider reserves the right to amend these Terms. Existing Users will be notified of material changes by email at least fifteen (15) days before they take effect. Continued use after the changes take effect constitutes acceptance of the new Terms. If the User does not agree to the changes, they may close their account in accordance with section 14.2.

16. Governing law and dispute resolution

These Terms shall be interpreted and applied in accordance with the law of the Republic of Slovenia. Matters not expressly governed are subject to the Code of Obligations (OZ) and the Electronic Commerce and Electronic Signature Act.

The parties shall endeavor to resolve all disputes amicably. If this is not possible, disputes shall be resolved by the competent court in Maribor.

Consumers have the right to alternative dispute resolution via the European Online Dispute Resolution Platform.

17. General and final provisions

If any provision is or becomes invalid or unenforceable, this shall not affect the validity of the remaining provisions. These Terms, together with the Privacy Policy, Cookie Policy, Disclaimer, and Price List, constitute the entire agreement between the Provider and the User.

The Provider may transfer its rights and obligations to a legal successor or affiliated entity without the User's prior consent, while the User's rights shall remain unaffected.
